TPS for Somali Nationals: Eligibility & How to Apply

Temporary Protected Status (TPS) provides critical protection for Somali nationals in the United States. Columbus, Ohio is home to one of the largest Somali communities in the country, and many community members rely on TPS. This guide explains eligibility, the application process, and important deadlines.

What is TPS?

TPS is a temporary immigration status granted to nationals of countries experiencing ongoing armed conflict, environmental disasters, or other extraordinary conditions. Somalia has been designated for TPS since September 2012 due to ongoing armed conflict and extraordinary conditions.

Eligibility Requirements

To qualify for TPS under the Somalia designation, you must:

  • Be a national of Somalia (or a person without nationality who last habitually resided in Somalia)
  • Have continuously resided in the United States since the most recent designation date
  • Have been continuously physically present in the United States since the most recent designation date
  • Not have been convicted of any felony or two or more misdemeanors in the United States
  • Not be subject to any bars to TPS
  • File during the registration or re-registration period

How to Apply

Initial Registration

  1. File Form I-821 (Application for Temporary Protected Status)
  2. File Form I-765 (Application for Employment Authorization) if you want a work permit
  3. Submit two passport-style photos
  4. Pay applicable fees or request a fee waiver (Form I-912)
  5. Provide proof of nationality (Somali passport, birth certificate, or other evidence)
  6. Provide proof of continuous residence and physical presence in the U.S.

Re-Registration

If you already have TPS, you must re-register during each re-registration period. USCIS announces these periods in the Federal Register. Key points:

  • File Form I-821 to re-register
  • File Form I-765 to renew your work permit
  • File during the announced re-registration period (typically 60 days)
  • Late re-registration is possible with good cause

Required Documents

  • Somali passport (even if expired) or national ID
  • Birth certificate with English translation
  • Proof of U.S. entry (I-94 record, passport stamps, airline records)
  • Proof of continuous residence (lease agreements, utility bills, school records, medical records, pay stubs)
  • Two passport-style photos
  • Any previous TPS approval notices
  • Police clearance or court records (if applicable)

Filing Fees (2026)

  • Form I-821: $50
  • Form I-765: $410
  • Biometric services: $85
  • Fee waiver available (Form I-912) for those who qualify based on income

Important Tips for Columbus Somali Community

  • Do not miss re-registration deadlines. Set reminders and file as early as possible in the registration period.
  • Keep copies of everything you file. Maintain a complete file of all TPS-related documents.
  • Report address changes to USCIS within 10 days using Form AR-11.
  • Maintain valid employment authorization. Your EAD must be current to work legally.
  • Consult an immigration attorney if you have a criminal record or complex situation.
