What This Form Is

Form I-130 is the Petition for Alien Relative. This form is filed by a U.S. citizen or lawful permanent resident to establish the relationship with an eligible family member who wishes to immigrate to the United States. It is the first step in most family-based immigration cases.

Who Can File (Petitioner)

A U.S. citizen or permanent resident can file for:

  • Spouse
  • Unmarried children under 21
  • Unmarried children 21 or older
  • Married children of any age
  • Brothers and sisters (U.S. citizens only)
  • Parents (U.S. citizens only, must be 21+)

Priority Categories

  • Immediate Relatives (no visa wait): Spouse, unmarried children under 21, and parents of U.S. citizens
  • Family Preference Categories (visa wait required):
    • F1: Unmarried adult children of U.S. citizens
    • F2A: Spouses and children of permanent residents
    • F2B: Unmarried adult children of permanent residents
    • F3: Married children of U.S. citizens
    • F4: Siblings of U.S. citizens

Required Documents

  • Proof of petitioner's U.S. citizenship or permanent residence
  • Birth certificates (petitioner and beneficiary)
  • Marriage certificate (if filing for spouse)
  • Divorce decrees (if previously married)
  • Passport photos of both parties
  • Evidence of bona fide relationship (photos, joint accounts, etc.)
  • Proof of legal name changes (if applicable)

The Process

  1. File Form I-130 with USCIS along with supporting documents
  2. USCIS Review - USCIS will review and may request additional evidence
  3. Approval - Once approved, the case is sent to the National Visa Center (NVC)
  4. Visa Processing - If beneficiary is abroad, they go through consular processing. If in the U.S., they may file I-485 for adjustment of status

Concurrent Filing

If the beneficiary is in the U.S. and eligible, Form I-130 can be filed concurrently with:

  • I-485 - Application to Adjust Status (get Green Card)
  • I-765 - Application for Employment Authorization
  • I-131 - Application for Travel Document
