What This Form Is

Form I-539, Application to Extend/Change Nonimmigrant Status, is used by nonimmigrants currently in the United States to apply for an extension of their authorized stay or to change to a different nonimmigrant status. This form is commonly used by visitors, students, and dependents of work visa holders who need to extend their time in the U.S. or switch to a different visa category.

Who Can File

  • Nonimmigrants seeking to extend their current status (e.g., B-1/B-2 visitors)
  • Nonimmigrants seeking to change to a different status (e.g., B-2 to F-1 student)
  • Dependents of principal visa holders (H-4, L-2, etc.)
  • Must have been lawfully admitted to the U.S.
