What is Form I-751?

Form I-751, Petition to Remove Conditions on Residence, is filed by conditional permanent residents who received their green card through marriage. If you were married for less than two years when your green card was approved, you received a conditional card valid for only two years. You must file Form I-751 to remove these conditions and obtain a permanent 10-year green card. At Asal Multi Services in Columbus, Ohio, we help couples and individuals prepare their I-751 petitions accurately.

Joint Filing (with spouse)

The standard method requires both spouses to sign the petition. Provide extensive evidence of a genuine marriage:

  • Joint federal tax returns
  • Joint bank account statements
  • Joint lease, mortgage, or property deed
  • Joint utility bills or insurance policies
  • Birth certificates of children born to the marriage
  • Photographs together over time
  • Affidavits from friends and family

Waiver of Joint Filing

You may request a waiver if:

  • Divorce: Marriage was entered in good faith but ended in divorce
  • Abuse: You were subjected to battery or extreme cruelty by your spouse
  • Death: Your spouse passed away during conditional residence
  • Extreme hardship: Termination of status would cause extreme hardship

Filing Process

  1. File within the 90-day window before your conditional green card expires

  3. Gather extensive evidence of your bona fide marriage
  4. Submit the petition with filing fee to USCIS
  5. Receive I-797C receipt notice which extends your green card for 48 months
  6. Attend interview if USCIS schedules one
  7. Receive your 10-year green card upon approval
Fees: Check the USCIS fee schedule

Frequently Asked Questions

When should I file Form I-751?

You must file Form I-751 within the 90-day window before your conditional green card expires. Filing too early results in rejection. Filing late without good cause may terminate your conditional residency.

What if I am divorced before filing I-751?

You can still file Form I-751 with a waiver of the joint filing requirement. Provide evidence that your marriage was entered in good faith, plus your final divorce decree.

What evidence do I need for I-751?

Joint tax returns, joint bank accounts, joint lease or mortgage, joint insurance, birth certificates of children, photographs together, and affidavits from people who know your relationship.

How long does I-751 processing take?

Typically 12 to 24 months. USCIS automatically extends your green card validity for 48 months from the I-797C receipt date while your I-751 is pending.
