What This Form Is

Form I-821, Application for Temporary Protected Status, is used by nationals of designated countries to apply for or re-register for Temporary Protected Status (TPS). TPS is granted to individuals who are unable to return to their home country due to ongoing armed conflict, environmental disasters, or other extraordinary conditions. TPS provides protection from deportation and eligibility for work authorization.

Who Can File

  • Nationals of a country designated for TPS by the Department of Homeland Security
  • Must have been continuously physically present in the U.S. since the designated date
  • Must have been continuously residing in the U.S. since the designated date
  • Must not have been convicted of any felony or two or more misdemeanors in the U.S.
  • Current TPS holders seeking re-registration during a designated re-registration period
  • Individuals who are admissible as immigrants or eligible for a waiver of inadmissibility

Required Documents

  • Evidence of nationality (passport, birth certificate, or national ID)
  • Evidence of continuous residence in the U.S. since the designated date
  • Evidence of continuous physical presence since the designated date
  • Proof of identity with photograph
  • Passport-style photographs
  • Form I-765 (Application for Employment Authorization) if requesting work permit
  • Court records (if applicable for criminal history)
  • Previous TPS approval notice (for re-registration)
