What This Form Is
Form I-821D, Consideration of Deferred Action for Childhood Arrivals, is used to request deferred action under the DACA program. DACA provides temporary relief from deportation and work authorization to individuals who were brought to the United States as children and meet specific eligibility requirements. DACA recipients must renew their status every two years.
Who Can File
- Individuals who came to the U.S. before their 16th birthday
- Have continuously resided in the U.S. since June 15, 2007
- Were physically present in the U.S. on June 15, 2012, and at the time of filing
- Were under the age of 31 on June 15, 2012
- Had no lawful immigration status on June 15, 2012
- Are currently in school, have graduated high school, obtained a GED, or are an honorably discharged veteran
- Have not been convicted of a felony, significant misdemeanor, or three or more misdemeanors
- Current DACA recipients seeking renewal
Required Documents
- Proof of identity (passport, birth certificate, school ID, or government-issued ID)
- Proof of arrival in the U.S. before age 16
- Evidence of continuous residence since June 15, 2007 (school records, medical records, employment records)
- Proof of physical presence on June 15, 2012
- Proof of education status (school enrollment, diploma, GED, or military records)
- Form I-765 (Application for Employment Authorization) filed concurrently
- Passport-style photographs
- Previous DACA approval notice (for renewals)
