When USCIS Rejects Nigerian Court Affidavits

Nigerian court affidavits are commonly used in Nigeria to establish facts when formal records don't exist or have errors — but USCIS's acceptance of affidavits has become more scrutinized. A court affidavit changing a birthdate or correcting a name is not automatically accepted as primary evidence of that date or name. We advise clients on when to use affidavits, when to seek the underlying document (like an LGA birth certificate), and how to structure the evidence package so that USCIS understands why the affidavit was needed.

Frequently Asked Questions — Nigeria

What is NIN and do I need it for immigration documents?+
The National Identification Number (NIN) is Nigeria's biometric national ID. It is now required for Nigerian passport renewal applications. If you do not have your NIN, you must register through the National Identity Management Commission — which can sometimes be done at Nigerian embassies or consulates. We advise on this process.
USCIS sent me an RFE saying my Nigerian birth certificate is insufficient. What do I do?+
This is common. Nigerian LGA birth certificates issued close in time to the birth ("contemporaneous" records) carry more weight with USCIS than late registrations. If your birth certificate was registered years after your birth, USCIS wants additional secondary evidence. We help you build this: school records, church baptism records, parent's passport photos, family Bible entries, medical records — any evidence that corroborates your date of birth.

Nigerian official documents are in English — birth certificates, marriage certificates, court records are all in English. We do not offer translation from Yoruba, Igbo, or Hausa for official documents because these are not used on Nigerian government certificates. However, if you have personal letters or community documents in these languages, contact us and we can discuss your specific situation.

Nigerian passport renewals are handled through VFS Global offices in the US on behalf of the Nigerian Immigration Service. The Nigerian Embassy in Washington DC and consulates in Atlanta and New York handle other consular matters.
